Terms and conditions

1. JURISDICTION

The sale is construed in accordance with the French law and its validity, construction, interpretation and legal effect shall be governed by the French laws. The appropriate jurisdiction for any legal dispute and lawsuits filed under this agreement shall be filed in France.

4. SELLER’S CONTRACTUAL CONDITIONS

The order is made via the www.tubesaessais.com website.

Price:

Prices are given in Euros inclusive of all taxes existing when the prices were input on the website. The shipping fees are indicated before validation of the order by the client.
If a tax or contribution should be created or changed, this change could be reflected on the prices. The prices are guaranteed except in case of mistake by the seller when inputting the data on the website, and except in case of wrong display of the price on the client’s browser.

Order acceptation:

Any order shall imply full acceptance by the buyer of the price and description of the products ordered. In any case, input by the buyer of his/her payment card identifiers is a proof of the order and a proof that its payment is exigible (according to the french law of march 13, 2000 on electronic signature). The confirmation screen on the website and email sent to the client does not constitute an acceptation by the seller of the order. In case of wrong computation of the order amount, the seller can reject the order. The seller shall inform the buyer as soon as possible and refund the complete payment done by the buyer, using the same payment method.

Cancellation:
In case of mistake by the buyer when ordering, if the buyer informs immediately the seller by email, the seller shall make its best effort to cancel the order if it was not shipped, and refund the complete payment done by the buyer, using the same payment method. In case the order was already processed, the buyer shall use the withdrawal procedure described below.

Products are available in limited quantity. If the product ordered is not available, the seller shall inform the buyer as soon as possible and refund the complete payment done by the buyer, using the same payment method.

In case there is doubts on the buyers identity and address, the seller can require a proof of address. If the address can’t be verified, the seller can cancel the order. The seller shall inform the buyer as soon as possible and refund the complete payment done by the buyer, using the same payment method.

Withdrawal:

Under French law, the buyer can withdraw with seven days after reception of the goods. The buyer shall send the seller the goods unsealed and in perfect conditions at his own cost. The seller shall then refund the complete payment done by the buyer, using a payment method at the seller choice before thirty days.

Returns for guarantee:

In the cases described in 3. the buyer shall send the seller the defective products, indicating the exact defect. The seller shall deliver to the buyer a replacement for the defective product and refund the shipping costs incurred by the buyer (limited to standard postal service shipping cost). If the product is not available anymore, the seller shall refund the buyer using a payment method at the seller choice before thirty days.

Payment:

The payment methods accepted are those supported by the PayPal platform.

5. DELIVERY

Delivery is done by standard postal service. Delivery costs depend on the destination.

The seller shall send the products within seven days after reception of the order. In case of delay longer that seven days after the expected shipping date not justified by force majeure, the buyer can cancel his order by registered letter with acknowledgment of receipt. The seller shall then refund the complete payment done by the buyer before thirty days.

6. PERSONAL DATA

The seller shall not use the buyers personal data for other purpose than processing his order, unless agreed by the buyer. Personal data shall only be transmitted to third parties for the sole purpose of handling the order. The seller website can redirect the buyer to the PayPal website during the order. The seller shall not bu held for responsible for the handling of his personal data by PayPal.

According to the french law (n. 78-17 of january 6, 1978 modified by law n. 2004-801 of august 6, 2004), the buyer has a permanent right of access, of objection and correction by contacting the seller by way of standard mail or electronic mail, at the address indicated in 2.
